TERMS OF SERVICE – ER-GEAR

These e-store sales conditions (hereinafter "Terms") apply to ER-GEAR OÜ (registry code 17396870), operating under the business name ER-Gear, located at Männiku tee 112-305, 75506 Nõmme linnaosa, Estonia (hereinafter "ER-Gear") and the webstore on domain er-gear.ee (hereinafter "Webstore").

By using the Webstore and placing orders through it, the user (hereinafter the "User") confirms acceptance of these Terms.

1. GENERAL PROVISIONS

1.1. The Webstore sells handcrafted tactical equipment, including custom-made products, to private and business customers under these Terms.

1.2. These Terms apply to any sales contract concluded via the Webstore. Any deviations must be agreed upon in writing.

2. PRICES

2.1. All prices displayed in the Webstore are in euros (EUR) and include VAT. Shipping costs are calculated at checkout.

2.2. ER-Gear may change prices at any time. Orders submitted before price changes are processed according to the prices valid at the time of order.

2.3. If a product price is displayed incorrectly due to a technical error or human mistake, ER-Gear reserves the right to cancel the order and issue a full refund. The User may re-order at the corrected price.

3. ORDERING AND PAYMENT

3.1. Orders are placed by adding products to the cart and completing the checkout process.

3.2. Payments are processed securely via Montonio AS.

Accepted payment methods:

  • Bank Link,
  • PayPal,
  • Bank wihtdrawal

3.3. The sales contract is concluded once the payment is received.

4. DELIVERY

4.1. ER-Gear ships worldwide, except to high-risk destinations [Non EU and not North-America states.].

4.2. Delivery options:

  • Omniva parcel service (Estonia and international)
  • Local pickup from Männiku tee 112-305, Tallinn (upon agreement)

4.3. Delivery times:

  • In-stock items (Estonia): 1–3 business days
  • Custom-made items: timeframe depends on complexity and material availability – communicated directly with the customer
  • International delivery: [up to 30 days]

4.4. In exceptional cases, delivery may take up to 45 calendar days.

5. RIGHT OF WITHDRAWAL

5.1. The consumer has the right to withdraw from the sales contract within 14 days after receiving the goods.

5.2. The right of withdrawal does not apply to:

  • Custom-made or personalized products
  • Legal entities (business customers)

5.3. Returned goods must be unused and in original condition.

5.4. The buyer covers return shipping costs unless the product was defective or incorrect.

5.5. To request a return, email info@er-gear.ee within the withdrawal period. No formal withdrawal form is required.

5.6. Refunds are processed once the returned goods are received. ER-Gear may withhold the refund until goods are received or proof of return is provided.

6. COMPLAINTS

6.1. The User has the right to submit a complaint within two years of receiving the product, provided the defect existed at the time of delivery.

6.2. Complaints must be submitted by email to tellimused@er-gear.ee within two months of discovering the defect.

6.3. ER-Gear responds to complaints within 15 days. If the complaint is valid, the product will be repaired, replaced, or refunded.

7. PERSONAL DATA AND MARKETING

7.1. ER-Gear collects and processes only the personal data necessary to fulfill and deliver orders (e.g., name, address, contact information).

7.2. No customer accounts are created or maintained.

7.3. Payment data is handled securely by Montonio AS.

7.4. Data may be shared with transport partners for delivery purposes.

7.5. Users may subscribe to newsletters via the Webstore footer. Unsubscribing is possible anytime via email or link provided in newsletters.

8. DISPUTE RESOLUTION

8.1. Disputes should first be resolved by contacting tellimused@er-gear.ee or +372 53731824.

8.2. If no agreement is reached, the User may file a complaint with the Consumer Disputes Committee (https://komisjon.ee) or use the EU platform at https://ec.europa.eu/consumers/odr

These Terms are valid from 26.01.2026.
